These Terms of Service ("Terms") govern your access to and use of the website www.alejandriaflowers.com, our Shopify online store, and the floral products and services provided by Alejandria Flower Art LLC, doing business as Alejandría Floral Art | Luxury Florist Miami ("Company," "we," "us," or "our"). Please read these Terms carefully before using our services.

1. Acceptance of Terms

By accessing or using our website, placing an order through our Shopify store, or visiting our physical location, you confirm that you are at least 18 years of age, that you have read and understood these Terms, and that you agree to be bound by them and all applicable laws and regulations of the State of Florida, USA. If you do not agree to these Terms, please do not use our services.

2. Services Provided

Alejandria Flower Art LLC provides floral design, arrangement, and retail services including, but not limited to:

  • Custom floral arrangements and bouquets for personal and corporate use

  • Wedding, quinceañera, and event floral design and decoration

  • Same-day and scheduled flower delivery in the Miami/Coral Gables area

  • Sympathy and funeral floral arrangements

  • Online ordering through our Shopify store at www.alejandriaflowers.com

  • In-store retail at 1516 Ponce de Leon Blvd, Coral Gables, FL 33134

  • Floral subscription and corporate account services

The specific scope of services for custom or event orders will be outlined in a separate Order Confirmation or Service Agreement.

3. Online Store and Shopify Terms

Our online store is powered by Shopify. By placing an order through our website, you also agree to Shopify's Terms of Service and Privacy Policy. We reserve the right to:

  • Refuse or cancel any order at our discretion

  • Limit quantities of any products or services

  • Modify or discontinue any product or service without notice

  • Update pricing at any time; prices shown at checkout are final

4. Client Responsibilities

By engaging our services, you agree to:

  • Provide accurate, complete, and timely information necessary for us to fulfill your order

  • Ensure delivery address information is correct and accessible

  • Be available or designate a recipient to receive floral deliveries

  • Respond to communications in a timely manner to avoid order delays

  • Make payments according to the agreed schedule

5. Intellectual Property

All content, logos, graphics, floral designs, strategies, and materials created by or belonging to Alejandria Flower Art LLC are protected by applicable copyright and trademark laws.

Upon full payment, custom floral arrangements created specifically for your order become your physical property. However, Alejandria Flower Art LLC retains the right to:

  • Use photos of arrangements in our portfolio, website, and social media (without disclosing confidential client information)

  • Retain all proprietary design concepts, templates, and frameworks used to deliver the service

6. User Consent for Communications

By submitting your information through any form on our website, at checkout, or in-store, you expressly consent to receive communications from Alejandria Flower Art LLC via:

  • Email: including order confirmations, invoices, newsletters, and promotional content

  • SMS/Text messages: as described in our Privacy Policy (Section 3)

SMS/Text Messaging Terms: If you opt-in to receive SMS/text messages from us, message frequency varies. Message and data rates may apply. You can cancel the SMS service at any time by replying STOP. For assistance, reply HELP or contact us at contact@alejandriaflowers.com. Consent is not a condition of purchase.

7. Payment Terms

All online payments are processed securely through Shopify Payments, Stripe, or PayPal. For custom and event orders:

  • A deposit of 50% is required to confirm and begin work on custom or event orders

  • The remaining balance is due 7 days before the event or delivery date

  • Invoices for corporate or subscription accounts are due within 15 calendar days of issuance

  • Late payments may incur a late fee of 1.5% per month on outstanding balances

  • Services may be paused or cancelled for non-payment after 30 days past due

  • Deposits for event and custom orders are non-refundable once work has commenced

8. Cancellations, Returns & Refunds

Due to the perishable nature of floral products, all sales are generally final. Our policy:

  • Online orders: Cancellations requested at least 48 hours before scheduled delivery may receive a store credit

  • Same-day orders: Non-refundable once the order has been confirmed and preparation has begun

  • Custom and event orders: Non-refundable after the deposit has been paid and work has commenced

  • In-store purchases: All sales are final; exchanges for equal value may be considered within 24 hours

  • Damaged or incorrect items: Must be reported within 24 hours of delivery with photographic evidence — we will replace or issue store credit at our discretion

  • If we are unable to fulfill your order due to circumstances on our end, you will receive a full refund

9. Flower Substitution Policy

Alejandria Flower Art LLC strives to fulfill all orders exactly as described. However, due to the natural variability of floral products and seasonal availability, we may need to substitute flowers or greenery of similar quality, color, and aesthetic value. We will always maintain the overall style and price point of your original order.

10. Delivery Policy

Delivery availability and fees are specified at checkout. We currently deliver within the Miami-Dade and Broward County area. Please note:

  • We are not responsible for failed deliveries due to incorrect addresses or inaccessible delivery locations

  • If no recipient is available, a second delivery attempt may incur an additional fee

  • We are not liable for delays caused by traffic, weather, or other circumstances beyond our control

11. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the engagement. Alejandria Flower Art LLC will not disclose your personal information, event details, or order information to third parties without your written consent, except as required by law or to deliver the contracted services.

12. No Guarantee of Results

Alejandria Flower Art LLC will use its best efforts and professional expertise to fulfill your floral order as described. However, we cannot guarantee exact replication of arrangements shown in reference photos, as natural flowers vary in color, size, and availability. We will always maintain the spirit and aesthetic of your vision.

13. Limitation of Liability

To the fullest extent permitted by law, Alejandria Flower Art LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services or website, including but not limited to:

  • Loss of revenue, profits, or data

  • Business interruption

  • Damages resulting from natural disasters, supply chain issues, or other circumstances beyond our control

  • Damages resulting from third-party platform changes (e.g., Shopify, Meta, Google)

Our total cumulative liability shall not exceed the total fees paid by you in the three (3) months preceding the event giving rise to the claim.

14. Termination

Either party may terminate a service or subscription agreement with written notice. Upon termination:

  • You are responsible for all fees incurred up to the termination date

  • We will deliver all completed deliverables paid for in full

  • Both parties will return or destroy any confidential information of the other party

15. Dispute Resolution

In the event of a dispute arising out of or relating to these Terms or our services, both parties agree to first attempt to resolve the matter through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, USA. You irrevocably submit to the exclusive jurisdiction of the courts of Miami-Dade County, Florida for any matters not subject to arbitration.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the effective date at the top of this document. Your continued use of our services after such changes constitutes your acceptance of the updated Terms.
